Motion to Dismiss

Client with more than 15 felony arrests and more than 10 misdemeanor arrests gets arrested for selling crack cocaine to an undercover officer. State offers 10 years. Law enforcement says that the transaction is recorded on video. He is subject to prisoner release reoffender and habitual offender penalties which could easily result in a 20-year day-for-day sentence. The State was confident in their case because of the video. We watched the video and found that the sale was actually to a confidential informant not an undercover officer. Therefore, we were entitled to the identification of the confidential informant. We filed a motion to compel the confidential informant’s identity. At the hearing the State agreed to give us the information but advised they could not do so immediately. The judge gave them 3 days, which they let pass. A Motion to Dismiss the case was filed, and the State dropped the charges before the hearing. One very happy client.

Fender Bender

An elderly gentleman with basically no prior record becomes enraged with his former girlfriend after she refuses to make payment on a car they own jointly but refuses to give him the car. They both live in the same over 55 neighborhood. She would not answer his calls or accept the registration certificate from him. One night after a year of this foolishness he sees her go by his house, and he follows her in his car. She pulls into her driveway and parks in her garage. He then drives into her driveway and smacks his car into her car with her in it 2 times. He flees the seen, but is promptly arrested after she calls 911. He is charged with leaving the scene of an accident and 2 counts of aggravated battery with a deadly weapon. This made him eligible for prison. The State wanted 6 months in the county jail because the elderly former girlfriend was very angry and scared of my client. Both the defendant and the victim testified at the sentencing hearing, and even though the judge was not happy with my client’s behavior he gave him straight probation.

Uncle Sam

The next case involves a federal charge of theft from the federal government. Our client, due to certain family connections, managed to illegally and feloniously occupy Section 8 housing for 6 years to which she was not entitled There were additional allegations of income tax fraud. The total was in excess of $150,000. These matters were finally found by the federal authorities. Mr. Orr, handling the defense, managed to make an arrangement where the client’s culpability was totally minimized and her jail time exposure was reduced to 1 year. At sentencing the client was genuinely remorseful. The federal government asked for 6 months. The judge gave the client probation which she was quite excited about.

Amateur Hour

An 18-year-old male who engaged in a fairly amateurish and clumsy armed robbery with a firearm of a person he knew from school over an Xbox. Since a gun was used he was exposed to the possibility of life in prison. In any event, he scored out to 11 years in the Department of Corrections because he also had multiple burglaries of automobiles and grand theft charges. The State demanded 10 years in prison and generally that’s what
these young people get for robbery with a firearm. After we told the judge he was a good kid from a good family that had somehow gone wrong, the judge gave him two years in prison. A thing that happened which Mr. Orr had never seen was his entire large family in the audience started cheering, applauding, jumping up and down they were so excited and happy that he got that break.
